FALLEN TREE AND LAMPOST HIT MY TAXI

On 310909,at about 1130hrs ,while i was travelling from Jurong West St 64 to Jurong West Ave 4 my taxi was hit by a fallen tree n followed by alampost.Luckly i manage to moved my taxia bit forward.At first i dun realise what happen.There was a loud "bang" at my rooftoop.I only realise it when i came to a complete stop.Damn lucky i'm still alive today.Taxi was towed to Loyang.Then next day i made lodge a report at Loyang n followed by a police report.I was given phone number of the personwho's in charge of repairing the taxi n lost of income dept.On Monday i try to call the both numbers but no one answer.Try to call them few times still the same.Comes Tuesday try to call again still the same.Sian, i straight went to Sing Ming.Reach there,i ask tis guy under T LOAN Dept, of whom i suppost to see about my case.He then bring me to level 3 and from there a lady assist me.Show her all my report and even the Newpaper that came out about the unfortunate accident.She then made a few calls.Then after the calls she told me that my repair will need around a week .When i ask about my lost of income,she told me that maybe i won't get it cause that is Gov property.Huh,i did not knock down the tree nor lampost!Why can'ti claim?One question i did ask,if i knock down either one of those,i still have to pay for it right?One thing she suggest me was to T Loan another taxi.I,m still today got fobia about that day and itstill fresh inside my mind.To me, God juz give me another chance to live.Right now i juz wan to relex my mind b4 my own taxi comes out from workshopno.Anyone can give me advice of what should i do?????

Go Comfort, girl says not her problem ... Lamp post maintain by LTA
Go LTA , man says not his problem ... trees maintain by NEA
Go NEA, uncle saysnot his problem, taxi from comfort

and the loop goes on and on ...

Sorry I dun have a solution, juz some jokes to brighten up your day biggrin

Generally they call these cases act of the almighty, so cannot claim.
Unless you saw someone chop down the tree or push down the lamp post, otherwise you gota check with that guy up there liao....

I remerber my friend taxi got hit by fallen tree once andhe said he claim NEA cause nea need to ensure as they do regluar check.detail i not too sureconfuse

Repair cost will be borne by them but lost of income still not sure yet.

YES ! U can bring NEA or N Parks or who so ever to the court for the damages of your A380,,,
BUT u got to get your OWN lawyer (as your's cab company's insur. said its act of GOD & they boh chap)
1st of all ,,, Your lawyer will ask U to pay a UPFORNT deposit of $1,000 - $5,000
after which ,,, U will have to go lawyer office few times to take statment/interview/affidavit/PTC meeting,,, (times & ERP & parking fee involved!)
and ,,, on the actual day ,,, U have to go to the court to kpkb ,,,
and,, the court will rule 10% your fault (as you can avoid it as if u are not there)& 90% on third party as this is not a Intentionally Set Up !!
its mean ,,, third party will pay 90% of your damages (including your legal fee) ,, fair ?? yes !!
but the the BEST part is,,,,,,,,
10% of your legal fee will cost more then $2,000 !! belive me !!
so,, U want to pay $1K or $2.5k (may be) ?!?!?!

In my opinion the term Act of God is always being abused.

Naturally effect such as stone fallen from slope in the midst of earthquake, lightening, storm, rain all these non-man-made source I can understand; but fallen branch of tree.... hah... could due to improper pruning, fallen lamp post could due to poor installation so the owner and contractor need to bear.

Meaning you still driving T-Loan Taxi??? Better go workshop and have a look, see if your cab still there awaiting repairs or they already take it as total loss. At least you know what should be your next step, they keep quiet you better do something.

Yes, cannot claim...Natural disaster can only claim from Ti Gong...maybe your number open in the 4D...Huat Ar!!!!......Normal car insurane also don't insure on this.....

Juz received letter from Comfort ask me to pay $1000!!!!Now no income ask me to pay!Siow!Monday going to Sing Ming.What they are trying to do?????Tree hit tha cab bit i must pay????Really pissed of!All they are concern is money.Why never claim from whoever in charge of the both thing?Some more at the letter they put 5 times installment and they choose the date to pay!Now drivers better be carefull when driving must look out for trees and lampost.Not only traffic n passengers.Lol......

my opinion is this;

1- you cant claim loss of income becos you are still fit to drive.
loss of income is eligible if only you are unfit to drive.

2- you should claim the NEA becos they are suppose to maintain the trees.
for your case, becos it was NOT happened on a rainy day, your case is stronger.

3- if i were you, i will blow this issue BIG by going to the media to wake up all the
parties involved. the NEA, LTA and comfort. becos your incident was published on
papers and media, many would be interested to know the outcome. so if they
are not acting in favour to you, and it was not your fault, SHOOT THEM! evileye

let me know if you need my help, i know someone from the press that maybe

interested to publish your story. wink
